HSC-bay Terms and Conditions

The term "bidder" is used to describe any eligible person who sets up an online auction account for the Hillfield Strathallan College HSC-bay Online Auction The term "Auctioneer" is used to describe Hillfield Strathallan College

1. Acknowledgment
By participating in the online auction, each bidder acknowledges that he/she has read, understands, and agrees to the rules, conditions and information set forth herein.

2. Eligibility
Bidding is open to registered bidders who are 18 years or older at time of Entry.

3. Entry
To participate in the HSC-bay Auction, bidders must set up an online auction account by completing all required information and following all instructions on the online auction registration page at www.hsconlineauction.on.ca/register.php

4. Time of Auction
The online auction opens at 12:00 p.m.(noon) on Friday, November 5, 2010 and closes at 10:00 p.m. on Sunday, November 21, 2010. 

5. Bidding
Some auction items may be subject to a reserve bid and/or a minimum bid.  This will be clearly stated.  All bidding is by pre-determined increments. Bidding by irregular increments is not allowed. The Auctioneer reserves the right to reject a bid from any bidder. 

A bid is a legal contract to buy.  Once a bidder enters a bid amount, the bidder will be required to confirm the bid. By doing so, the bidder agrees to pay the amount bid with 48-hours of the auction closing should he or she be the successful bidder. A bid may not be retracted at any time after it has been confirmed.

No bids will be accepted before or after the applicable closing dates and times set forth in Paragraph 4, above.  The highest bid acknowledged by the Auctioneer at the time the auction item closes shall be the purchaser.  In the event of a dispute between bidders, the Auctioneer shall have the sole and final discretion either to determine the successful bidder, or to re-offer and re-sell the item in dispute.

A sale will be considered complete when the bids officially close at the applicable closing dates and times.  ALL SALES ARE FINAl. There will be no exchanges, credits or refunds.

6. "As-Is" Condition without Warranty or Representation
All items not covered by a manufacturer’s warranty are offered on an "As-Is" basis, and descriptions offered are based on information supplied to the Auctioneer by the Donors of the items.  The Auctioneer offers no warranties or representations of any kind with respect to the accuracy or completeness of the description of the items, or with respect to the condition of the items, their fitness, purpose, merchantability or quality.  Bidders are advised to direct questions or concerns about an item in advance of the closing of the auction to Kim Shippey, Advancement Manager at 905 389 1367, ext. 107 or kim.shippey@hsc.on.ca
Gift certificates or other items may come with a date or other restrictions and bidders must inform themselves about these restrictions.

7. Purchaser Notification and Payment
Once the auction has closed, the highest bidder on any given item will be notified immediately by e-mail. The successful bidder will be required to complete payment to HSC on their item(s) within 48-hours.  Should the full purchase price not be received within 48-hours of the close of the auction, the Auctioneer reserves the right to cancel the sale and award the winning bid to the next highest purchaser. Purchaser is solely liable for any taxes, shipping or delivery, use or other fees that may apply.
All payments must be completed online through PayPal ™,  using any major credit card.

8. Pick up of Purchased Items
All items will be available for pick up at the College from the Main Office (Holton Building) on the following dates and times:

Thursday, November 25, 2010 from 8:30 am - 10:30 am and from 3:00 pm - 5:00 pm
Friday, November 26, 2010 from 8:30 am - 10:30 am and from 3:00 pm - 5:00 pm
Monday, November 29, 2010 from 8:30 am - 10:30 am and from 3:00 pm - 5:00 pm

All successful bidders should ensure that they are able to arrange to pick up their item(s) during the above times.  Please contact Kim Shippey at 905- 389-1367, ext. 107 if you are unable to collect during these times. 

9. Other Information
Hillfield Strathallan College is a registered charitable educational institution, CRA charitable no. BN11895 7810 RR0001.  All proceeds from this event will be directed to the benefit of the students of Hillfield Strathallan College.  Payments for items purchased are not eligible for tax receipts.  Donations of items may be eligible for a tax receipt.  Please contact the Advancement Office at 905-389-1367 if you require further information.

10. Limitations of Liability
By purchasing items at auction the buyer waives any claims for liability against Hillfield Strathallan College (HSC) or the donors of the property, and neither HSC nor the donors are responsible for any personal injuries or damage to person or property that may result from utilization of items purchased through HSC-bay online auction.

11. Waivers
HSC-bay, the Auction, the Auctioneer and all offerings of items, as well as any bids and resulting sales shall be deemed to be undertaken and completed in Hamilton, Ontario Canada and deemed to be governed solely by the laws of the Province of Ontario, Canada. Registrants, Bidders, Buyers, and users of HSC-bay each waive the right to bring a claim in any court located outside the Province of Ontario over any claim arising under or related to these Terms and Conditions, HSC-bay, the Auctioneer, or any transaction consummated hereunder. All Registrants, Bidders and Buyers shall be solely responsible to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding their use of the HSC-bay service and their bids, purchase and use or ownership of items.
